What Is The Cellphone Law In New York State?

New York State has had a ban on using cellphones while driving a vehicle since 2001. The "Hands-Free" law allows drivers to use their cell phone if they have a hands-free device paired with it; otherwise, they cannot use or touch their phone, even at a stoplight or stop sign.

What Are The Penalties For Violating New York's "Hands Free" Law?

You could face Fines. The First offense fines range from $50 to $200. Subsequent offenses within 18 months are fined more heavily.
Points could be added to your license. A conviction of violating the "hands-free" law adds 5 points to your driving record.
A mandatory surcharge of up to $93 can be applied.
