
Avoid Giving These Out On Valentine’s Day In New York
Valentine's Day is near and millions of New Yorkers will be looking to surprise that special someone with something special.
There is one thing you might want to avoid giving them this Valentine's Day unless you are ready to make a commitment.
One of the most popular candies for Valentine's Day are the candy message hearts. They are the little heart candies that say "I Love You", "Miss You", or "Hug Me"

This year the company that makes them, Sweethearts Candies has added a special feature to some of the hearts. They are called "Binding Hearts" and if you give that special someone a "Marry Me" heart, you are engaged!

So the big question is, "Are these hearts really a binding agreement?"
In New York State there are certain criteria that need to be met if an agreement is to be considered binding.
They include:
Offer and Acceptance: There must be a clear offer to contract and an unqualified acceptance in order for a contract to be enforceable.
Consideration: Each party involved in the contract has to promise or provide something of value to the other.
Intent to be bound: The parties must understand what they're doing and must intend to be bound by their agreement.
Mutual assent: Mutual assent signifies that both parties agree to the essential terms they are setting.
Contracts don't have to be written if an oral or "heart" contract meets the above criteria.
Of course, it will be hard to prove the "Intent" of a candy heart in a court of law but you just never know, so be careful with who you give candies to this Valentine's Day.
